1. Acceptance of Terms

By creating an account or using Swan ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Swan is a content publishing platform that allows you to connect social media accounts (including TikTok, Instagram, YouTube, and X) and publish content across those platforms from a single dashboard.

This includes accessing your public profile information, video metadata, and posting capabilities as authorized by you during the login process.

3. User Accounts

  • You must provide a valid email address to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must not share your account or allow others to access it on your behalf.

4. Content and Conduct

You retain ownership of all content you publish through Swan. By using the Service, you agree that:

  • You have the right to publish all content you submit, including images, text, and any associated media.
  • Your content does not infringe on any third-party intellectual property rights, privacy rights, or other legal rights.
  • Your content complies with the terms and community guidelines of each connected platform (e.g., TikTok Community Guidelines).
  • You will not use Swan to publish content that is illegal, harmful, defamatory, or misleading.
  • Content must not contain watermarks from other platforms or unauthorized brand overlays.

5. Third-Party Platforms

Swan connects to third-party platforms through their official APIs. Your use of those platforms is also governed by their respective terms of service. Swan is not responsible for changes to third-party APIs, platform policies, or content moderation decisions made by those platforms.

Swan does not sell, rent, or lease any data retrieved from TikTok or other third-party platforms to third-party data brokers or advertisers.

6. Music and Audio Content

When you enable the "Add music" option, TikTok may add background music to your content. By enabling this feature, you acknowledge and agree that your content may include music subject to TikTok's music usage policies and licensing terms. You are responsible for ensuring your use of any audio content complies with applicable copyright laws.

7. User Consent Before Posting

Swan requires explicit user action (clicking "Post") before any content is published to a connected platform. Content is never published automatically without your confirmation.

8. Commercial Content

If your content promotes a product, service, or brand, you must enable the commercial content disclosure toggle before publishing. This ensures compliance with platform advertising policies and applicable regulations.

9. AI Content Generation and Disclosure

If you use Swan's AI tools to generate content, you are responsible for ensuring such content is labeled as AI-generated in accordance with TikTok's Synthetic Media Policy and applicable C2PA standards.

10. Limitation of Liability

Swan is provided "as is" without warranties of any kind. We are not liable for any content published through the Service, failed publications, data loss, or any damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the preceding 12 months.

11. Termination

We may suspend or terminate your access to Swan at any time if you violate these terms. You may delete your account at any time. Upon termination, we will delete your data in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
